Brethren Churches Need Registration

Now a days many Brethren churches registered under the Charitable society act, is it necessary ? The Pentecostal churches are registered. Is it Biblical ?

In many places in our country it is essential for an organized social or spiritual activity to be registered. For example, if an assembly received offerings per year beyond a certain amount, or if it wishes to possess property, it needs to be registered.

The word of God reminds us to obey the government and civil authorities for the sake of Christ.

Consequently, there is a need for registering in CERTAIN cases, specially when it involves trasaction of large amount of funds or other activities that require accountability, trasparancy, legal, or quasi-legal endorsement.

In Kerala there is no law/ rule about  registration of churches or religious organisations. Therefore no registration is possible. But when a new building is constructed, the building permit for religious organisations are to be obtained from Chief Town Planner (CTP) in Trivandrum. In Kottayam District, a special clearance form the Collector and the Police are also required. Thus an indirect registration for Church building is there though  no registration for Churches are required.
 
But if there is a complaint from the people in the neighbourhood, a  Church can face some problems. If the area is one which has a Detailed Town Planning Scheme (DTPS - many of the Municipal areas  are covered under such Schemes), the Church can be located in areas specially earmarked for institutions. If the file is properly processed and sanctioned by the CTP, they would have ensured this. If not, then a court can order the shifting of the church if it is located in a non institutional area. Therefore when lands are purchased it should be ensured that it is an area earmarked for instituions if there is a DTPS in the particular area.

About registration:  This is required in USA, if the organization wants tax exempt status.  If the annual collection exceeds certain amount, then they need to obtain a tax exempt status as a charity organization from the Internal Revenue Service (IRS).  Then only the contributors could claim their contribution to be tax exempted in their personal income taxl filing.

This is not exactly right. On the contrary, there are at least two laws related to Religious and Charitable institutions that are indeed applicable to churches in Kerala. One functions from Trichur and above, and the other south of it. What we can say rightly is that there is no compulision in Kerala to register, and therefore most of the assemblies have not registered themselves. However, the law is there and some have taken advantage of it in Kerala.

Outside Kerala also there is very little compulsion, but the laws are there.
